In India, copyright arises automatically when you create an original work. But when someone copies you, a host, platform or court will ask: can you prove copyright ownership? Here's what counts as proof.
Strong forms of proof
- Original files: the highest-resolution photo, RAW files, PSD/AI/Figma files, Word drafts
- Metadata: camera EXIF data (date, device), file creation history
- Publication dates: CMS post dates, sitemap dates, social posts, Google indexing dates
- Archive copies: Wayback Machine snapshots of your page. See evidence of online infringement
- Contracts and invoices: for commissioned work, the agreement showing assignment to you. See who owns website design
- Version history: Google Docs/Git history showing the work being created
- Copyright registration certificate: strong prima facie evidence. See copyright registration in India
For photos
- Keep RAW/originals; publish smaller web versions
- Take a few frames of the same scene (copiers rarely have them)
- Consider subtle watermarks or IPTC copyright info in the file
For website text
- Keep drafts and CMS revision history
- Note publish dates
- Your earlier indexing in Google helps show who published first
For designs and code
- Design files with layers and history
- Git commits with dates
- Handover documents. See software copyright
If you hired someone
Ownership may sit with the creator unless assigned in writing. Get a written assignment, especially for logos, photos and website designs. See logo copyright.
Using your proof
Attach the strongest two or three items to your notice. Joboo Web's legal request form lets complainants upload ownership proof directly.
FAQs
Is posting first on Instagram enough proof?
It helps establish a date, but original files are stronger.
Do I need registration to send a takedown notice?
No. Registration helps but isn't required to claim copyright.
