Businesses sometimes register domains like "brandname-service-ludhiana.com" or "brandnamedealer.in" to attract searches. When a trademark appears in a domain name, it can lead to disputes, takedowns or forced transfer of the domain. Here's how trademark and domain name conflicts work.
When it's risky
- Domains containing a well-known brand you don't own (e.g. car brands, telecom companies, banks)
- Domains that look like the official site
- Domains used to redirect brand searches to competitors
- Domains registered to sell back to the brand owner (cybersquatting). See cybersquatting in India
Legitimate uses that may be acceptable
- Authorised dealers or resellers, with the brand's permission
- Genuine review or criticism sites (with care and clear non-affiliation)
- Using descriptive words that happen to be part of a mark, in good faith
Even then, brand owners may object. Get permission in writing where possible.
What brand owners can do
- .in domains: INDRP complaint. See .in domain dispute guide
- .com and other gTLDs: UDRP complaint. See UDRP guide
- Court action for trademark infringement or passing off
- Complaints to hosts, registrars, Google Ads
Choosing a safe domain
- Use your own business name
- Combine your brand with service and location (e.g. yourbrand-taxi.in)
- Check trademark databases before registering a brand-like domain
- Avoid typos of famous brands
See how to choose a domain name.
If you receive a complaint
- Don't ignore it. Disputes can proceed without your response
- Gather evidence of your good-faith use and any permissions
- Consult a lawyer quickly
